PHC directs Provincial Assembly session to be called within a fortnight

PESHAWAR: The Peshawar High Court (PHC) has ordered the newly elected Khyber Pakhtunkhwa assembly session to be held within fortnight.
The PHC has issued a detailed judgement here today on the contentious issue of newly elected members of the Khyber Pakhtunkhwa (KP) Assembly not being able to take oath on reserved seats. The delay in oath taking has also caused the senate elections in the province to be delayed, over lack of quorum for the elections.

Justice SM Atiq Shah, presiding over the case, penned down a comprehensive 24-page judgment, addressing the legal intricacies surrounding the matter.
The court has unequivocally ordered the Chief Minister of Khyber Pakhtunkhwa and the provincial cabinet to take immediate steps to convene a meeting of the KP Assembly. This directive is in accordance with Article 105 of the Constitution, mandating the assembly to be summoned within 14 days.
Prior to the upcoming Senate elections, the PHC has instructed that these newly elected members must be sworn in promptly. Additionally, the court has specifically directed the Speaker of the KP Assembly to administer the oath to the members holding special seats.

The ruling emphasised that the obstruction of newly elected members from taking oath on certain seats is a clear violation of the Constitution, underscoring the importance of upholding the democratic process.
